As an estate planning attorney in California, almost every potential client I speak to thinks that having a will in place will avoid probate. They are definitely surprised when I tell them that isn’t the case! I’m curious if other practice areas have similar common misconceptions about the law.
(As a bonus, I worked as a legal assistant at a plaintiff’s side employment law firm before law school. The amount of people who called wanting to sue their employer for wrongful termination after they showed up late for a shift would have been comical if I wasn’t the only intake person in my department!)
